Is it legal to sell an imported Ugg Boot from Australia in a retail UK store if we state it is NOT the Deckers?

The brand name is different, but the boot still has the word “UGG” on the label along with their name brand. Is it okay to open this shop with this product?

  1. rhearosie says:

Only if it is in New Zeland

    Well, it depends.

“UGG” is a registered trademark of Deckers in the UK, so selling something they don’t make marked “UGG” is a trademark infringement.

BUT… it may well be that the company that sells the UGG boot in Oz is actually a subsidiary or partner company of Decker, in which case it’s not infringing to sell their product.
